流動應用程式(app)收集用戶通訊錄繼續發酵,私隱專員公署晚上回應傳媒查詢,指在網上公開資料,分享給他人使用,可能已經犯法。
私隱專員公署以新聞稿方式回應傳媒就相關軟件有否犯法時回應,先是提到用戶若將通訊錄上載,而又並未取得相關通訊錄內的當事人同意,有機會違反有關使用資料的保障資料原則,但亦提到若相關人士不願追究會有取證困難的問題。此外,公署提醒用戶在轉移其他人的資料時,目的有否更改。
至於在網上公開資料,新聞稿中有這樣的回應指:「即使是公開資料,並已放在網上任人查閱,但若有人收集及整合、分析後再供他人 使用,已與當初收集資料的目的不同;加上有程式要付費作搜尋電話號碼之用,已非當初取得通訊錄的原意,有可能已犯法。」至於應用程式開發商不在香港的問題,公署則回應指最有效的解決方法便是透過國際聯繫,聯絡境外相關的個人資料保障執法機關跟進事件。
香港個人資料私隱專員(「私隱專員」)黃繼兒在新聞稿中亦表示已聯絡境外相關的個 人資料保障執法機關跟進事件,同時繼續密切注意事態發展,並向巿民提供簡易按序要求停用個人資料的辦法。
另外,獵豹移動繼早上發出新聞稿後,晚上再出聲明,先重申《CM Security》連續 9 次獲得國際評測機構 AV-TEST 滿分第一名認證,並表示《WhatsCall》用戶資料皆存放在 Amazon Web Services 海外伺服器,資料均經過加密保存,安全無虞,更表示有心人士在已知政要號碼的情況下竟然將該號碼反查證實其真實身份,以證明 《CM Security》洩露別人私隱,此說法顯然有失偏頗。
